For merchants using Lit applications

Terms of Service

These Terms cover your business's use of Lit applications and services, including Lit Loyalty, and our responsibilities when processing data for you.

1. Scope and acceptance

These Terms of Service are an agreement between LIT (Lit, we, or us) and the merchant or business installing or using our applications and services (you). They apply to Lit applications, including Lit Loyalty, and related services provided to merchants.

By installing or using a Lit application or service, you accept these Terms on behalf of your business and confirm that you have authority to do so. If you do not agree, do not install or use the service.

These Terms govern your relationship with Lit. They are separate from the terms and privacy notices you provide to your own customers. Where a separate client agreement, data processing addendum, or app-specific terms apply, that more specific document controls for the relevant service to the extent of a conflict.

2. Services

Lit provides software, applications, and related services to help merchants operate their businesses. Functionality, platform integrations, and available features vary between Lit applications and are described in the relevant app listing or service documentation.

We may maintain, update, or change the services over time. Availability can be affected by maintenance, technical issues, or changes to Shopify and other connected platforms.

3. Merchant responsibilities

You are responsible for using the services lawfully, complying with applicable platform requirements, and protecting your account credentials and access permissions.

You must have the necessary rights and legal basis to make merchant and customer data available to Lit and to instruct us to process it. You are responsible for providing required customer notices, obtaining consent where required, and ensuring your instructions comply with applicable law. Only make data available that is needed for the service.

4. Customer and merchant data

Lit may process merchant, store, and customer data as necessary to provide the services you use. The data involved depends on the application, its functionality, the permissions granted, and the integrations you connect.

When processing customer data on your behalf, Lit acts as a processor, service provider, or similar role in accordance with your lawful instructions, these Terms, our Privacy Policy, and applicable law. Your use and configuration of the service, permissions, and requests to us provide those instructions.

Data made available to Lit for the service is used only to provide, secure, support, and operate the service and to meet applicable legal obligations. Customer data processed on your behalf is not Lit's own marketing list.

Lit may separately act as a controller for merchant account, billing, support, and other business contact information, as explained in our Privacy Policy.

5. Data protection and security

Lit uses reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, misuse, loss, or alteration. No environment can be guaranteed to be completely secure.

You should also use appropriate access controls, credential management, and security practices when using the services.

6. Privacy requests

Lit supports applicable privacy and data-subject requests relating to personal information processed through its services, including access, correction, deletion, and other rights under applicable law.

Where Lit processes customer data on your behalf, you remain responsible for responding to your customers' requests, and we will provide reasonable assistance relating to the data we process for you. Customers may need to direct their requests to you first. Merchants can contact Lit using the details below for assistance, including with applicable platform privacy and redaction requests.

7. Data retention and deletion

Personal information is retained only as reasonably necessary to provide the service and meet applicable operational, contractual, and legal obligations, including troubleshooting, recordkeeping, and dispute resolution.

Retention depends on the type of information, the service, and applicable obligations. Data processed on your behalf is retained, deleted, or otherwise handled in accordance with the relevant agreement, your lawful instructions, applicable privacy requirements, and established retention practices described in our Privacy Policy.

8. Service providers

Lit may use hosting, infrastructure, communications, security, support, and other service providers to operate the services. These providers may process information needed for their work, subject to appropriate contractual or legal restrictions.

Lit operates from Israel and may use providers or infrastructure in other jurisdictions. International processing and applicable protective measures are described in our Privacy Policy.

9. Intellectual property and permitted use

Lit and its licensors retain their rights in the applications, software, documentation, and branding. While you comply with these Terms and any applicable service agreement, you may use the service for your business for its intended purpose.

You must not misuse the service, interfere with its security or operation, attempt unauthorized access, or copy, resell, or distribute Lit software without permission except as allowed by applicable law.

You retain your rights in the data and content you provide. You authorize Lit to process that data and content only as needed for the purposes described in these Terms.

10. Suspension and termination

You may stop using a service at any time, including by uninstalling the relevant application and disconnecting its integrations. Any separate subscription or service agreement governs applicable cancellation and payment obligations.

Lit may suspend or end access where reasonably necessary to address a breach of these Terms, unlawful use, security risks, or a legal or platform requirement. We will provide notice where reasonably practicable.

When the service ends, your permission to use it ends. Personal information will continue to be protected and retained, deleted, or otherwise handled according to section 7 and our Privacy Policy, including applicable merchant instructions and legal obligations. Ending use does not require immediate deletion of records that must be retained for those purposes.

11. Changes to these Terms

We may update these Terms to reflect changes in the services or applicable requirements. Updated Terms will be published on this page. For material changes, we will provide additional notice where appropriate or required by law.

Continued use of the service after updated Terms take effect constitutes acceptance of those Terms, subject to any notice or consent requirements under applicable law. If you do not agree, stop using the service.

12. Contact information

For questions about these Terms or assistance with data protection requests, contact LIT at contact@litapp.ai.

If a Lit app listing, customer agreement, or data processing addendum identifies a more specific legal entity or privacy contact for a service, use that service-specific contact for the relevant matter.

13. Privacy Policy

Our Privacy Policy complements these Terms and explains how Lit collects, uses, shares, and protects personal information, including its roles when processing information for merchants and for its own business operations. Read it alongside these Terms.
